Terms & Conditions

These Terms & Conditions ("Terms") govern your use of IDAKADAM ("we", "us"), an online property marketplace that lets owners, agents and developers in Sri Lanka list property for sale and rent, and lets people browse those listings. By creating an account, posting a listing or otherwise using the website, you agree to these Terms, our Privacy Policy and our Posting Rules. If you don't agree, please don't use IDAKADAM.

1. Who can use IDAKADAM

• You must be at least 18 years old and able to enter into a binding agreement.
• You must give accurate details when you register and keep them up to date.
• You are responsible for everything done through your account. Keep your password secret and tell us straight away if you think someone else has used it.
• One person or business may not use multiple accounts to get around limits, bans or pricing.

2. Our role

IDAKADAM is a venue. We are not the buyer, seller, landlord or tenant of any property listed, we don't own, inspect, value or guarantee any property, and we don't check ownership or title. We are not involved in the transaction between users: any deal is a contract between the parties. Please use our safety advice: view the property before you commit, and have an attorney-at-law check the deeds, survey plan and title history before you pay anything.

3. Listings

• Your listing must describe a real property that you own or are authorised by the owner to offer, at a genuine price, in the right property type and location.
• You must follow our Posting Rules, which list what may not be listed.
• You keep ownership of the text and photos you post. You give IDAKADAM a non-exclusive, royalty-free licence to host, display, resize and promote them on our website and marketing channels for as long as the listing is on the site.
• You must only upload photos you took or have permission to use.
• We may edit a listing's category or formatting, or remove or refuse any listing that breaks these Terms, the Posting Rules or the law, without notice.

4. Prices, packages and promotions

• Prices are shown in Sri Lankan Rupees (LKR) on our pricing page. They include any charges you will pay to us, and we don't add hidden fees at checkout.
• Free listing: each account can post a limited number of free listings in categories that allow them.
• Packages are one-time payments, not subscriptions, and never renew automatically. Listing and promotion credits must be used within the validity period shown (currently 30 days from purchase). Unused credits expire at the end of that period.
• Single paid listings: some property types may be posted as single paid listings at the price shown for that type before you pay.
• Promotions such as Featured, Urgent, Highlight, Top and Bump up give a listing extra visibility for the period stated. They don't guarantee a sale, a tenancy, a number of views or enquiries.
• Payments are processed by PayHere. By paying, you also agree to PayHere's terms. Refunds follow our Refund Policy.
• If we change a price, the new price applies only to purchases made after the change.

5. Acceptable use

You must not:

• post false, misleading, duplicate or illegal listings, or listings for prohibited content;
• scam, defraud, threaten, harass or discriminate against other users;
• send spam or unsolicited advertising through messages or listings;
• collect other users' contact details for any purpose other than the deal you are discussing;
• copy or scrape content from IDAKADAM by automated means without our written permission;
• interfere with the website's security or operation, or try to access accounts or data that aren't yours;
• impersonate another person or business, or misrepresent your connection with them.

6. Reviews and messages

Reviews must reflect a genuine experience with the seller. Messages sent through IDAKADAM should relate to a listing. We may remove reviews or messages that are fake, abusive or break these Terms, and we may review reported messages to investigate abuse.

7. Suspension and termination

We may suspend or close an account, remove its listings and refuse future registrations if a user breaks these Terms or the law, or puts other users at risk. Where reasonable, we'll tell you why. Credits on an account closed for a serious breach are not refundable. You can stop using IDAKADAM and delete your account at any time from your dashboard.

8. Intellectual property

The IDAKADAM name, logo, website design and software belong to us or our licensors. You may not use them without our written permission, except to link to IDAKADAM in a fair and non-misleading way.

9. Liability

• We provide IDAKADAM "as is". We work to keep it available and secure, but we don't promise it will be uninterrupted or error-free.
• Because we are not a party to deals between users, we are not responsible for the quality, safety, legality or delivery of items or services, the truth of listings, or the conduct of users.
• To the extent the law allows, our total liability to you for any claim relating to IDAKADAM is limited to the amount you paid us in the 12 months before the claim.
• Nothing in these Terms limits liability that cannot be limited under the laws of Sri Lanka, including your rights under the Consumer Affairs Authority Act, No. 9 of 2003.

You agree to compensate us for losses caused by your breach of these Terms or by content you post, to the extent the law allows.

10. Reporting problems

Use the Report option on a listing or seller profile to flag a listing or user, or contact us. If you believe a listing infringes your copyright or trademark, send us the listing link and details of your rights and we'll review it promptly.

11. Changes to these Terms

We may update these Terms as IDAKADAM changes. We'll post the new version here with a new "Last updated" date and, for significant changes, notify registered users. Continuing to use IDAKADAM after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. The courts of Colombo have jurisdiction over any dispute, although we'll always try to resolve a concern with you directly first.
